Goldback, Inc., is committed to protecting your privacy and your personal information (“PI”). This policy governs the use of data and practices of Goldback’s website. Please review this policy carefully to make informed decisions about sharing your PI.

Goldback does not sell or otherwise disseminate your contact information to third parties except to allow or enable you to make online orders through account portal owners and operators, and to allow Goldback to fulfill your orders through third parties that provide fulfillment services.

Goldback’s website also automatically collects certain non-PI from your device by the interaction of your device with Goldback’s website. Such information includes the following:


1.1   Cookies

Goldback’s website uses “cookies” to identify areas on our website that you have visited. A cookie is a small piece of data stored on your device by your web browser. Goldback does not use your PI with this cookies feature. Rather, Goldback uses cookies to personalize content you see on our website. Your web browser can be set to disable the use of cookies.

1.2   Third party tracking tools

Goldback may use third party tracking tools like Mail Chimp and/or Google Analytics to improve the performance and features of our website. These tools are intended to only collect non-PI from your use of Goldback’s website. Because such tools are created and managed by parties outside Goldback’s control, Goldback is not responsible for the actual information collected by such third parties, or how such third parties use and protect that information.

Google offers a web analytics service that tracks and reports website traffic. Google uses the data collected from Goldback’s website to track and monitor use of our website. Google shares this data with other Google services and may use such data to personalize its own ads. You can opt-out of this use of your activity on Goldback’s website by installing the Google Analytics opt-out browser add-on, which prevents this use of your information. 1.4   Log information

Goldback may receive the following information from your device: (1) the name of the website from which you entered Goldback’s website, (2) the name of the website you go to when you leave Goldback’s website, (3) the IP address of the computer/proxy server you used to access the internet, (4) your internet website provider name, (5) your computer operating system, (6) your type of mobile device, and (7) your web browser type. To the extent Goldback receives such information, it uses it to analyze trends to help improve the content and appearance of information on our website.

2.   Why Goldback Uses Your PI

Goldback may use the foregoing information as follows:

Goldback may use the foregoing information along with any other computer information we receive to customize and improve our website.

2.3   For data aggregation purposes.

Goldback may collect and use non-PI collected from your use of Goldback’s website to aggregate for internal analytics that improve the website and services Goldback provides you. Goldback does not use your personally identifiable information in such data aggregations.

2.4   Transfer of Your PI.

Your information, including PI, may be transferred to computers located outside of your state, province, country, or other jurisdiction where the data protection laws may differ than those from your jurisdiction. Goldback will take all steps reasonably necessary to ensure your PI and non-PI are treated securely and in accordance with this policy. No transfer of such information will take place to an organization or a country unless there are adequate controls in place including the security of such information.

3.   Retention and Disclosure of Your PI

Goldback will retain your information only as necessary for the purposes detailed in this policy. Goldback will also retain and use your information to the extent necessary to enforce our legal rights, resolve disputes, and comply with legal obligations (for example, if a law requires Goldback to retain your data for a certain period of time). If Goldback is involved in a merger, acquisition or asset sale, your PI may be transferred. Goldback will provide notice before your PI is transferred and becomes subject to a different policy.

4.   Further Information Regarding Your Data Protection Rights

Goldback is considered a data controller of your PI. Regarding businesses and individuals from the European Economic Area (“EEA”), Goldback may process your PI:

  • To make a payment
  • Because it is needed to fulfil or perform a contract with you, such as when you create an account with us or place an order with us
  • Because you have given us permission
  • Because it is in our legitimate interest, which outweighs your potential rights 
  • To comply with a legal requirement or obligation

If you are an EEA resident, you may have these additional data protection rights:

  • To access, update, or remove your PI
  • Restriction
  • Rectification
  • To object
  • Data portability

Finally, you have the right to file a complaint with a data protection authority relating to Goldback’s collection and use of your PI. Contact your local data protection authority in the EEA for additional information.

5.   Payment Processors

Goldback does not process your payments through third party credit card merchants. Rather, Goldback receives payments from you through e-checks, paper checks, and/or ECH. 

6.   Service Providers

Goldback may employ third parties (“service providers”) to facilitate our website, perform services related to our website, and analyze use of our website. These service providers may have access to your PI, but only to perform the foregoing tasks for Goldback.

7.   Links to Third-Party Websites

Goldback’s website may contain links to other websites that are not under Goldback’s direct control and that may have their own privacy policies. Goldback provides these links on our website only for your information and convenience. Goldback has no control over such websites, which are not subject to this policy. Please review the privacy policies of those other websites regarding their potential use of your PI. Please note that you access such websites at your own risk.

8.   Protecting Your Child's Privacy

Goldback’s website is not designed or intended for use by individuals aged 12 or younger (“Child” or “Children”). Goldback does not verify the age of individuals using our website, and does not verify the age of such individuals. Children should obtain the permission of a parent or guardian before using Goldback’s website. If you believe your Child is using Goldback’s website, we can remove your Child’s account upon request. If Goldback discovers a Child has created an account on our website, we will delete the account and not use the account information for any purpose, or share it with any third parties. Goldback is not liable for any transactions created by the Child prior to discovery by Goldback of the age of the Child.

You can opt out from receiving email correspondence from Goldback upon request to Goldback.

10.  Policy Updates

Goldback may update this policy at any time. If Goldback materially changes this policy, it may notify you through our website, by email, or other reasonable method of correspondence. Changes to this policy are effective on the date indicated below, and replace and govern prior versions of this policy.
